🚨 LE SÉNAT A VOTÉ. ET LE POUVOIR DE BLOQUER LES RÉSEAUX SOCIAUX EST TOUJOURS LÀ. Le 26 octobre, je vous alertais sur un amendement du gouvernement permettant de bloquer un réseau social qui refuserait de supprimer, sous une heure, un contenu appelant à « l'insurrection ». Cette nuit, le Sénat a adopté les amendements n° 50 et 94, dans une version remaniée. Qu'est-ce qui a changé ? Le gouvernement a abandonné la procédure d'urgence en une heure visant notamment les appels à l'insurrection. Mais attention : le mécanisme de blocage administratif, lui, a été maintenu ! Désormais, le texte prévoit que l'administration puisse exiger le retrait, sous 24 heures, de publications provoquant manifestement à certaines violences, vols ou dégradations, lorsqu'elles sont susceptibles de créer un « trouble grave à l'ordre public ». Et si la plateforme ne s'exécute pas ? ➡️ L'administration pourra demander aux fournisseurs d'accès à Internet de bloquer l'accès aux adresses du service concerné et aux moteurs de recherche de le déréférencer. Oui, cela peut aller jusqu'au blocage d'un réseau social entier en France. Et cela, sans autorisation préalable d'un juge. Des contrôles et recours existent, mais ils n'empêchent pas nécessairement la mesure initiale. Les hébergeurs récalcitrants risqueraient également jusqu'à 150 000 € d'amende, voire 2 % de leur chiffre d'affaires mondial pour les personnes morales. Tout cela dans un projet de loi consacré, je vous le rappelle, à la réparation des dégradations commises dans l'espace public. On nous présente ce dispositif comme un moyen de lutter contre les violences. Mais il soulève une question fondamentale : depuis quand l'administration doit-elle pouvoir faire bloquer l'accès à un réseau social sans qu'un juge ait préalablement autorisé cette atteinte à la liberté de communication ? Le Sénat a voté ce texte en première lecture. Il n'est donc pas encore applicable. 📄 Source : Sénat, article 1er bis D du texte adopté le 28 octobre 2026.
