Today, a coalition of 100+ signatories join DEF in sending a letter to Congress. Software developer protections are a non-negotiable in digital asset market structure legislation. This critical issue unites us — crypto and tech builders, investors, and advocates.

RT @lindsayfraser0: @BlockchainAssn 🤝 @fund_defi Congrats to our friends at DeFi Education Fund on an amazing event celebrating all of the incredibly important work they do to protect DeFi developers in the United States. Grateful to work with them and learn from them, but mostly grateful to call them my friends ❤️

RT @AvalanchePolicy: In this Crypto Quick Take, we are joined by @amandatums as she discusses why crypto legislation needs to distinguish between financial intermediaries and infrastructure. She explains how regulation should focus on control over other people’s funds, rather than the form of an entity or the technology it uses. Amanda also shares why a technology-neutral approach can help ensure regulations adapt as the industry evolves without unnecessarily restricting software developers. Thank you, Amanda, for sharing your insights, and we’ll be back next week with another Crypto Quick Take! #blockchain #education #crypto #regulation #policy #avalanche @fund_defi

The policy question most likely to shape the next century of American technology development is a legal one: when, if ever, does building software make you legally responsible for how other people use it? @amandatums & @glzavatone's POV on it:

The BRCA would have benefitted non-controlling developers in every segment of the software development world, not just those building on blockchain. Without it, non-controlling developers building tools that allow others to transfer their own funds do not have clarity as to when or if they will be considered a money transmitter subject to AML obligations. RT @punk6052: Great work @fund_defi (as always) and a pleasure to have worked with you on parts of the 2023 mixing PMLC proposal response.

Two wins for onchain privacy and self-custody today: 👉 FinCEN withdraws the 2023 mixing PMLC proposal 👉 FinCEN withdraws the 2020 unhosted wallet rule Both of these rules threatened to violate the privacy of crypto users and targeted self-custodial blockchain technology. While these proposals were dormant for the last few years, it is a good sign that they have been formally abandoned.  Thank you to FinCEN and Treasury leadership.

RT @amandatums: Heard 🫡 @ChairmanSelig today, on “onchain finance”: “we are also exploring a durable policy for developers who publish software but do not solicit or take orders, control execution, or hold customer assets. A person should not have to register as an introducing broker simply because that person shipped code. We are also working directly with builders to develop lawful pathways for onchain products in the United States. I’ve directed CFTC staff to engage with developers and founders to understand how onchain venues function, where control resides, how their activities compare to those performed by traditional market intermediaries, and how the CEA and our regulations apply to these new models.”

RT @amandatums: There are so many great @HesterPeirce quotes, but today I am particularly grateful for her distillation of what DeFi is and why it matters. But even with privacy, self-custody, and tech neutrality, Commissioner Peirce always was the best at articulating the principle of the thing while staying faithful to the securities laws. A million thank yous wouldn’t be enough for her service.

1/ In honor of Commissioner Peirce’s last day at the SEC, the DEF team wanted to take a moment to honor her legacy. Commissioner Peirce’s artfully-named speeches and thoughtfully-crafted dissents provide clear, compelling explanations on why decentralization matters and how innovation makes markets more resilient and accessible. RT @glzavatone: AI and crypto face the same fundamental policy question: When should developers be legally responsible for how other people use the software they build? @amandatums and I wrote for @fund_defi about why the answer will shape the next generation of American technology. And - it’s why we need to continue to advocate for developer protections in policy. 🧵 Linked here:
